Jahrestagung des SFB 626: Ästhetische Erfahrung im Zeichen der Entgrenzung der Künste
Ein ästhetisches Urteil zu fällen ist ein sehr komplexer Vorgang, der unsere Vermögen und Kräfte auf unterschiedlichste Weise involviert. Fällen wir ein solches Urteil, dann bestimmen wir etwas für gewöhnlich als Teil eines gewissen Bereiches, sprechen ihm gewisse Prädikate zu, betrachten es unter Aspekten seines Gelingens oder Misslingens, usw. Welche Rolle spielen Affekte in diesem Zusammenhang? Bilden sie vielleicht oft den entscheidenden Bestimmungsgrund eines ästhetischen Urteils? Und wenn ja, wie lässt sich eine normative Dimension des ästhetischen Urteils mit solch einer affektiven Grundierung vereinbaren? Diese Fragen stellen sich offensichtlich im Hinblick auf ästhetische Urteile, aber auch auf ganz ähnliche Weise im Hinblick auf Rechtsurteile. Genauer gesagt lässt sich hier fragen, in welchem Verhältnis das subjektive Rechtsgefühl und der Anspruch auf Objektivität im Rechtsurteil zueinander stehen. Außerdem bleibt zu klären, wie Affekte die normative Wahrnehmung von Fall und Recht durch Gerichte – sowie durch Öffentlichkeiten, die Rechtsurteile wiederum beurteilen – beeinflussen. Solche und ähnliche Fragen zur affektiven Grundierung von ästhetischen und juridischen Urteilen werden im Zentrum der Tagung stehen.

Affect and Judgment
Making an aesthetic judgment is a very complex activity, which involves our different capacities and powers in various ways. When making such a judgment, we determine something as being part of a particular sphere, we ascribe certain predicates to it, look at it according to specific ideas of success or failure, and so on. What role does the feeling of an affect play with respect to these activities? Is the feeling of an affect possibly the determining ground of every aesthetic judgment? And if yes, how can we reconcile the apparent normative dimension of an aesthetic judgment with its affective determination? Obviously, these questions must be asked with respect to aesthetic judgments, but in fact very similar questions have to be asked with respect to legal judgments. More precisely, it is far from clear how exactly our subjective sense of justice relates to the claim of objectivity that comes with every legal judgment. Moreover, one must ask how the feeling of an affect relates to a judge’s normative apprehension of a specific case or law, and how it relates to public opinions on the judgment that a judge eventually makes. At the conference, we will discuss these and other questions on the affective determination of aesthetic and legal judgments.
